Who is authorized to represent a client in an immigration proceeding in Canada
Immigration and Refugee Protect Act, section 91 specifies who can represent or advise a client regarding immigration matters.
a lawyer who is a member in good standing of a law society of a province or a notary who is a member in good standing of the Chambre des notaires du Québec;
any other member in good standing of a law society of a province or the Chambre des notaires du Québec, including a paralegal; or
a member in good standing of a body designated under subsection (5).
The body designated under subsection (5) refers to the College of Immigration and Citizenship Consultants (CICC), which is the legal entity designated under the College of Immigration and Citizenship Consultants Act 【Consultants Act】.
A member of CICC is called RCIC and is authorized to represent or advise a client in immigration proceedings.
Why use a RCIC as the immigration consultant
A client has many advantages of using a RCIC as an immigration consultant.
A RCIC is well trained in Canadian immigration laws, regulations and proceedings. The RCIC has to finish a 2-year program specialized in immigration laws, regulations and proceedings. Additionally, the RCIC has to update her/his immigration knowledge through the annual continuing professional development trainings in order to be competent. When it is the time to provide advices to a client, the RCIC has a solid knowledge base to guide the client through the complicated Canadian immigration proceedings.
A client’s interest is well protected when s/he chooses a RCIC to represent her/him. RCICs are strictly regulated by the Code of Profession Ethics. CICC investigates and disciplines every misconduct of RCICs. RCICs are required to put clients’ interest first.
RCICs are strong advocates of clients. The members will represent a client before IRCC or IRB, to explain, to request and to appeal their cases. If the client decides to take a case to the federal court, the RCIC will recommend a most suitable lawyer to represent the client in the court.
RCICs are more affordable. RCICs may save a client 30-50% of service fees comparing with those lawyer charges.
